Title 001: Offenses Against Public Order
Title 001.1.1 High Treason
Every one commits high treason who, in the UKA:
- (001.1.1.1) kills or attempts to kill His Majesty, or does him any bodily harm tending to death or destruction, maims or wounds him, or imprisons or restrains him;
- (001.1.1.2) levies war against the UKA or does any act preparatory thereto; or
- (001.1.1.3) assists an enemy at war with the UKA, or any armed forces against whom UKA Forces are engaged in hostilities, whether or not a state of war exists between the UKA and the country whose forces they are.
Title 001.1.2 Treason
(1.2) Every one commits treason who, in the UKA:
- (001.1.2.1) uses force or violence for the purpose of overthrowing the government of the UKA, a Commonwealth member state, or a province;
- (001.1.2.2) without lawful authority, communicates or makes available to an agent of a state other than the UKA, military or scientific information or any sketch, plan, model, article, note or document of a military or scientific character that he knows or ought to know may be used by that state for a purpose prejudicial to the safety or defence of the UKA or a Commonwealth member state;
- (001.1.2.3) conspires with any person to commit high treason or to do anything mentioned in paragraph (a);
- (001.1.2.4) forms an intention to do anything that is high treason or that is mentioned in paragraph (a) and manifests that intention by an overt act; or
- (001.1.2.5) conspires with any person to do anything mentioned in paragraph (b) or forms an intention to do anything mentioned in paragraph (b) and manifests that intention by an overt act.
Title 001.1.3 UKA Subjects and Treason
Notwithstanding Title 001.1.1 or 001.1.2, a UKA citizen or a person who owes allegiance to His Majesty in right of the UKA,
- (001.1.3.1)commits high treason if, while in or out of the UKA, he does anything mentioned in Title 1.1; or
- (001.1.3.2)commits treason if, while in or out of the UKA, he does anything mentioned in Title 1.2.
Title 001.1.4 Overt Acts
- (001.1.4.1)Where it is treason to conspire with any person, the act of conspiring is an overt act of treason.
Title 001.2.1 Punishment for High Treason
- (001.2.1.1)Every one who commits high treason is guilty of an indictable offence and shall be, upon conviction, sentenced to deathif he is found guilty of an offence under Title 001.1.1.
Title 001.2.2 Punishment for Treason
Every one who commits treason is guilty of an indictable offence and liable
- (001.2.2.1)to be sentenced to death or imprisonment for life at the discretion of the court if he is found guilty of an offence under Title 001.1.2.
Title 001.3.1 Corroboration
(001.3.1.1)No person shall be convicted of high treason or treason on the evidence of only one witness, unless the evidence of that witness is corroborated in a material particular by evidence that implicates the accused.
Title 001.4.1 Assisting alien enemy to leave the UKA, or omitting to prevent treason
Every one commits an offence who
- (001.4.1.1) incites or wilfully assists a subject of
- (i) a state that is at war with the UKA, or
- (ii) a state against whose forces UKA Forces are engaged in hostilities, whether or not a state of war exists between the UKA and the state whose forces they are,
to leave the UKA without the consent of the Crown, unless the accused establishes that assistance to the state referred to in subparagraph (i) or the forces of the state referred to in subparagraph (ii), as the case may be, was not intended thereby; or
- (001.4.1.2) knowing that a person is about to commit high treason or treason does not, with all reasonable dispatch, inform a justice of the peace or other peace officer thereof or make other reasonable efforts to prevent that person from committing high treason or treason.
Title 001.4.2 Punishment
- (001.4.2.1)Every one who commits an offence under Title 001.4.1 is guilty of an indictable offence and liable to imprisonment for a term not exceeding fourteen years of penal servitude at hard labor.
